Handling Human Rights Issues and Resolving the East Timor Problem: The Era of B.J. Habibie and Abdurrahman Wahid

However, the implementation of the Ad Hoc Human Rights Court faced significant challenges that affected its credibility and effectiveness. First, there was strong internal opposition from the military and static political elements who were reluctant to see high-ranking officers prosecuted. Second, the court has jurisdiction limitations, only handling cases in six specific regions and during the period of April-October 1999, ignoring violations outside that scope. This has led to many key defendants, especially those of high rank, being acquitted or receiving very light sentences. Third, issues of evidence and witness integrity also posed challenges, with many key witnesses afraid to testify. As a result, the court was widely criticized by international human rights organizations, the United Nations, and victims as a mechanism that failed to achieve basic justice, failing to meet international standards for fair and effective trials, as stated by the International Commission of Jurists (ICJ) in 2016.

A comparison of the two eras reveals a clear difference in focus. Habibie prioritized resolving East Timor's political status for Indonesia's strategic and diplomatic interests, aiming to relieve the burden of a prolonged issue. On the other hand, Gus Dur focused on the moral and legal dimensions, seeking to uphold justice for the victims through domestic judicial mechanisms.

Habibie's bold decision changed the regional political landscape and freed Indonesia from the burden of East Timor's colonization. However, the violence that accompanied it created a "human rights debt" that must be resolved. Gus Dur attempted to pay this debt through the Ad Hoc Human Rights Court, though the results were unsatisfactory, it set an important precedent for transitional justice efforts and human rights discourse in Indonesia.

The experiences of these two eras highlight the complexity of addressing human rights and transitional justice in Indonesia. Despite significant efforts by both leaders to confront the past, the challenge of immunity from punishment remains a crucial issue that has not been fully resolved. The legacy of Habibie and Gus Dur's leadership continues to shape the human rights landscape in Indonesia, providing valuable lessons for future efforts to resolve cases of gross human rights violations.
