To All Parents, Don't Open Your Children's Phone Without Their Permission, They Also Have Rights for Privacy!

When you were a kid or a teenager and then you got your first phone, have your parents taken your phone and seen what you were doing with your phone? If you have experienced the same thing, we're not different men. Parents at those times made checking their children's phone as a normal thing to do. They said they were concerned and worried about us using our phones.

But, one thing all parents in this country need to know right now is that it's not always okay to check their kids' phones without their permission or their consent. Whatever reasons that parents use to normalize that thing, even for the sake of their children's goodness, still a permission need to be gotten by the parents. And believe it or not there's actually a law that regulates and navigates about children having their privacy rights.

Kids and their rights

A child is described as a person under the age of 18, including those who are still in the womb, in article 1 number 1 of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 Concerning Child Protection. A number of children's rights are safeguarded by the legislation. 

Children's rights are fundamental human rights that must be protected by parents, families, neighborhoods, the state, and local governments. Every child has the right to be protected from abuse and discrimination, and to exist, develop, and engage in society fairly and in accordance with human dignity. Every kid has the right to practice their religion freely, to think and speak in ways appropriate to their intelligence and age, and to do so with the supervision of their parents or other adults.

Kids Rights for privacy  

Every child has the right to express themselves, to be heard, to receive and provide information appropriate to their age and intellectual capacity in order to develop themselves in accordance with the values of decency and decency. This right is in addition to the rights already stated. If we all see and try to understand, the right to speak up and be heard also involves the ability to withhold information or items that belong to a child from anyone, even their parents.

Every kid has the right to safety from discriminatory treatment, economic and sexual exploitation, neglect, cruelty, and other forms of abuse, as well as from injustice and other forms of mistreatment while in the custody of their parents, guardians, or other caregivers.

From all of those we can say that parents can't just take off their children's phone without the children giving the permission to their parents. It is legally wrong for parents to do that, since children's rights for privacy is protecting them from parents' arbitrariness.

Violation of Kids Privacy

Article 26 paragraph 1 of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 Concerning Information and Electronic Transactions regulates the protection of privacy, stating that, unless otherwise stated, any use of information through electronic media related to a person's personal data must have that person's consent. The protection of personal data in the use of information technology must then be viewed as a component of individual rights or privacy rights. Here are some definitions of the right to privacy:
