The issue of unilateral water disconnection in the Curahkembang area of Malang District, Indonesia, has sparked significant social and legal disputes. The disruption of a basic human need like water has left the residents in a state of uncertainty, with many expressing deep dissatisfaction over the management of this vital resource. This dissatisfaction stems from a perceived loss of control over the supply of water, a resource that directly impacts their well-being. The disputes arising from this crisis highlight a critical gap in addressing the intersection of legal and ethical dimensions in water governance, particularly in integrating religious principles with criminal law.
This essay explores the role of Qur'anic exegesis in addressing criminal law violations related to water disconnections, shedding light on how Islamic teachings can inform legal frameworks and contribute to conflict resolution. The analysis examines the commentaries of renowned Islamic scholars, Al-Qurtubi and Al-Razi, to illustrate how Qur'anic concepts such as justice, wisdom, and mercy can serve as a legal and ethical foundation for handling cases of water disconnection. In the Qur'an, water is often described as a gift from God, a source of life, and a symbol of divine mercy. These teachings present a strong moral argument against the denial of access to water, emphasizing the importance of justice and humanitarian principles in managing this essential resource.
The study demonstrates that the Qur'anic exegesis offers a powerful critique of water disconnection practices, particularly when it comes to legal systems that fail to incorporate religious values. The current local criminal legislation does not fully integrate these spiritual and ethical teachings, leaving gaps in the enforcement of water-related policies. As a result, the affected communities in Curahkembang are left to grapple with both legal and spiritual dilemmas that arise from the mismanagement of water resources.
The lack of clear religious guidance within the local legal framework undermines the community's trust in the governance system. The residents' dissatisfaction is rooted in a deeper concern that the spiritual and ethical aspects of water management are being overlooked. This gap between legal enforcement and ethical principles highlights the potential for interdisciplinary approaches that combine Islamic teachings with modern legal frameworks to address social justice issues more effectively.
In the context of the United Nations Sustainable Development Goals (SDGs), this issue connects directly with SDG 6 (Clean Water and Sanitation), SDG 7 (Affordable and Clean Energy), and SDG 17 (Partnerships for the Goals). By addressing the ethical implications of water disconnection through Qur'anic exegesis, this study underscores the need for policies that respect both human rights and environmental sustainability. SDG 6 calls for ensuring universal access to water and sanitation, while SDG 7 promotes affordable and clean energy, which is often tied to water resources. SDG 17 emphasizes the importance of partnerships in achieving these goals, including integrating religious perspectives into legal frameworks to foster more inclusive and just policies.
The interdisciplinary approach proposed in this study aims to contribute to conflict resolution by broadening the understanding of Islam's role in addressing legal and social issues. By incorporating Qur'anic principles into the formulation of water management policies, this research advocates for a more just and inclusive approach to governance. It emphasizes the importance of spirituality and social justice, ultimately offering a framework for developing policies that are rooted in both ethical and legal considerations. This approach can help create a more sustainable and equitable future for communities facing water access challenges, aligning with the global agenda of the SDGs.
